Introduction

These Terms of Use (the "Terms") are a legal agreement between you and The Global Note B.V., a company registered in the Netherlands (with the Chamber of Commerce under number 89192214) and located in Haarlem ("TGN", "we", "us" or "our"). These Terms apply to your access to and use of www.theglobalnote.com (the "Website") and any sub-domain of the Website.

You acknowledge and agree that by accessing or using the Website, you indicate that you have read and agree to be bound by these Terms. If you do not agree to these Terms, then you must stop accessing or using the Website.

Use of the Website

To use the Website you must be, and confirm that you are, of legal age (18 years of age or older, or otherwise the legal age in your jurisdiction, or if you have parental consent, 16 years of age or older) and able to agree to these Terms.

Access to the Website is granted on a temporary basis, and we reserve the right to withdraw or amend the services we provide on our Website without notice. We will not be liable for any reason in the event that the Website are unavailable at any time or for any period. Your access and use of the data available on the Website is only permitted in accordance with these Terms.

Any material, information or idea you transmit to us or Post by any means will be treated as non-confidential.

You hereby grant us a worldwide, non-exclusive, royalty-free, sub-licensable, and transferable license to use, share, reproduce, distribute, create derivative works of and display any User Content you upload or insert in the Website.

By posting or submitting User Content through the Website, you represent and warrant that you have, or have obtained, all rights, licenses, consents, permissions, power and/or authority necessary to grant the rights granted in these Terms, and you indemnify us for any breach of that warranty.

We have the right to remove any User Content if, in our opinion, your post does not comply with these Terms, is unlawful or contrary to good morals.

Account Registration

You may be required to create an account to use parts of the Website. If so, during the registration process, you must select a user name and password and provide us with additional information. You agree to provide us with accurate, complete, and current registration information about yourself. It is your responsibility to ensure that your password remains confidential and secure. Limitation of liability

We make every effort to operate the Website with reasonable care and skill. We provide the Website on an "as is" basis without warranty of any kind. We will do our utmost best to keep the Website available 24/7. We do not warrant that the Website are operational, compatible, error free, secure or that the Website will function without disruptions, delays or imperfections.

To the extent permitted by applicable law, in no event shall we be liable for any damages or losses incurred by you in connection with the Website or in connection with the use, inability to use, or results of the use of the Website and any materials posted on it.

Applicable law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject form or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with Dutch law.

Any dispute arising out of or in connection with an Agreement or these Terms, including disputes concerning the existence and validity thereof, will, if no amicable settlement can be reached, be exclusively submitted to the competent courts in Amsterdam, the Netherlands. If you are a natural person who is not acting in the performance of a profession or business, you can opt for settlement of the dispute at the competent court designated by law, within one month after we have invoked this clause.
